By using our services, you agree to these terms.
These terms and conditions apply to all services provided by PC Fix. When you book a repair or drop off your device, you are agreeing to the terms laid out in this document. Please read them carefully.
1. Payment Upon Completion: Payment for all services and parts is due in full upon the completion of the repair and before the device is released back to you.
2. Diagnostic Fees: If a quote is refused, the non-refundable diagnostic fee is payable in full upon your collection of the device.
3. Failure to Pay: If payment is not made of the full, agreed upon amount, or the release form is not signed, PC Fix reserves the right to retain your device and any parts installed until the balance is paid in full. We also reserve the right to pursue all available legal remedies to collect any outstanding payments.
4. Release of Device: The device will only be released to you upon full payment of any amount due and the signing of a release form confirming the return of the device and acceptance of its condition. This does not void or waive your repair warranty which is still valid as covered in 'Warranties'.
Data Backup and Privacy
This section outlines your responsibilities regarding your personal data. Please read it carefully.
1. Customer’s Sole Responsibility
You acknowledge that it is your sole responsibility to back up all data, software, and information stored on your device before submitting it for service. The repair process may involve actions that could lead to the loss, corruption, or destruction of your data, including, but not limited to, system wipes, hardware replacements, or unforeseen complications.
PC Fix is not liable for any loss, damage, or corruption of data that may occur during the repair process, regardless of the cause.
2. Our Optional Data Backup Service
As a separate service, and for an additional fee, we can perform, verify, and securely store a "best effort" backup of your user data. This service is provided to protect your data in the event of unforeseen issues during the repair process. Backup data is not provided post-repair unless the customer supplies a suitable external drive.
This service is not a guarantee and we do not warrant the successful or complete recovery of all data. Some files may be unrecoverable due to corruption, physical damage, or other pre-existing issues.
This service does not include the backup of the operating system, installed applications, or software licenses.
3. Secure Data Handling and Deletion
We will handle any data backups with the utmost care and store them on a secure, offline medium while your device is in our possession.
Upon signing the Service Outcome and Release Form and collecting your device, any backup data created by us will be securely and permanently deleted from our systems.
This deletion will be performed using a cryptographically secure data erasure method to ensure the data is unrecoverable. This process will be carried out as soon as reasonably possible, and in all cases, no later than 24 hours after the device has been collected.
This procedure is strictly for the protection of your privacy and to ensure no copies of your personal data remain on our systems.
4. Limitation of Liability for Data
You agree that PC Fix's liability for any damages, whether direct or indirect, arising from data loss, lost profits, or business interruption, is strictly limited to the cost of the services rendered.
5. Encrypted Data and Passwords
To perform a complete diagnosis or repair, we may require a temporary password, PIN, or other access details for your device. We use this information solely for the requested service. We are not liable for data loss that occurs due to your failure to provide a necessary password or key for encrypted data, such as with BitLocker.
6. Data Recovery Services
Data recovery is a "best effort" service, and we cannot guarantee the successful or complete recovery of all data from a failed, unhealthy, or damaged storage device. The customer will be liable for the full recovery price even if only part of the data is recovered, unless otherwise agreed upon.
This section defines the scope of our work and addresses potential issues that may arise during the repair itself.
By signing our repair intake form and submitting your device to us for repair, you acknowledge that electronic devices are inherently unpredictable and that the repair process carries a risk. Your device may be beyond repair or may be permanently damaged during repair and rendered useless. We are not liable for any new or existing faults that may become apparent during the repair, including the possibility that the condition of your device may change. Without a signed repair intake form we cannot work on your device.
1. Unforeseen Issues During Repair: You acknowledge that electronic devices can be unpredictable and that the value of your device may far exceed the cost of the repair. By submitting your device for repair, you accept the inherent risks of this process. We are not liable for any new or existing faults that may become apparent during the repair, including but not limited to:
The failure of a working component (such as a motherboard, CPU, GPU, or hard drive).
Software failure or data corruption.
The deterioration of a partially damaged component (e.g., a screen or chassis).
Our total liability for any damage or loss, even if caused by our actions, is strictly limited to the cost of the services rendered at that point. This limitation is an essential condition of our agreement, reflecting that the cost of our service is not proportionate to the replacement value of your device.
2. Pre-existing Conditions and Hidden Damage: We are not liable for any pre-existing damage, such as corrosion from liquid damage, damaged screw lugs, or worn-out internal parts, which may not have been visible during the initial assessment but are discovered during the repair process. This includes the deterioration of a partially damaged screen where the physical act of dismantling the device for diagnosis causes the existing damage to worsen. We will inform you of any such damage and recommend the best course of action, which may include terminating the repair.
3. Beyond Economical Repair: If, during the repair process, a device becomes un-repairable or the cost of the repair exceeds the reasonable value of the device, we will contact you to discuss your options. We are not liable for any costs incurred up to that point beyond the initial diagnostic fee.
4. Drive Encryption: We are not responsible for issues that arise with encrypted devices, such as those using BitLocker. If your device unexpectedly requires the unique 48-digit recovery key during a repair, we cannot proceed without it. We are not responsible for any data loss that may occur as a result of a missing or incorrect key.
Warranties
This section covers our repair warranties.
1. Our Repair Warranty
We offer a 30-day warranty on the specific parts and labour used for your repair.
The warranty period begins on the date you sign the Service Outcome and Release Form and collect your device. Warranty work within that period does not extend the warranty period.
If the same fault reoccurs within this 30-day period due to a failure of the parts or our workmanship, we will re-diagnose and, at our discretion, repair or replace the faulty components at no additional charge.
2. What Our Warranty Does Not Cover
New or Unrelated Faults: The warranty is strictly limited to the specific fault and the components repaired or replaced as listed on your invoice. It does not cover any new issues that may arise, nor does it cover any existing faults that were not part of the agreed-upon repair. For example, if we replaced your laptop's screen, the warranty does not cover a failing hard drive or a faulty keyboard key, even if those issues were present before we began work.
Customer-Caused Damage: The warranty is void if the device shows signs of accidental damage, misuse, liquid damage, or has been tampered with or repaired by another party.
Software and Viruses: Our warranty does not cover software faults, viruses, or malware that may occur after the repair is complete.
Consumable Items: The warranty does not cover consumable items such as batteries, which naturally degrade over time.
Customer-Supplied Parts: We provide no warranty on parts supplied by the customer. Our labour warranty is void if a new fault or a recurrence of the original fault is found to be a direct result of the faulty or incorrect part provided by the customer. In such cases, any additional labour will be charged at our standard rate.
Liquid Damage Exemption: Any device that shows signs of prior liquid damage is repaired on a strictly no-warranty basis. Due to the unpredictable nature of corrosion, these devices may develop new faults at any time, which are not our responsibility.
This section outlines our policies regarding pricing, quotes, and the process for when a repair is not completed.
1. Quotes and Estimates: All quotes provided are estimates based on our initial diagnosis. They are not a fixed or binding price. Due to the unpredictable nature of repairs and the possibility of unforeseen issues or parts, the final cost may vary. If the final cost of the repair is likely to exceed the original quote by more than 15%, we will contact you for your approval before proceeding. By authorizing the repair, you accept that the final cost may be different from the initial estimate.
2. Acceptance of Risk and Quote Process: By submitting your device to us for diagnosis, you accept the inherent risks of the repair process, including the possibility that the condition of your device may change. Upon the completion of our diagnosis, we will provide you with a detailed quote for the necessary repair. You agree that you will either accept or decline this quote.
3. Agreed-Upon Quotes: Once a repair quote has been verbally or digitally accepted by you, the price becomes fixed and is not subject to further negotiation and must be paid in full.
4. Right to Terminate Repair: PC Fix reserves the right to terminate a repair for any reason, at any time. This may be due to unforeseen technical difficulties, part availability issues, or if the repair is deemed to be a risk to our equipment. If we terminate the repair, you will still be responsible for the diagnostic fee, unless otherwise agreed.
5. Non-Refundable Diagnostic Fee: If you choose to decline the repair quote for any reason, you agree to pay a non-refundable diagnostic fee. This fee is based on the time and complexity of the diagnosis and will not exceed £45. The typical charge for most common faults is £20. This fee may be waived at our discretion if the fault is diagnosed in a very short amount of time. The fee covers the time and expertise required to assess the device and is payable regardless of whether the repair proceeds.
6. Condition of Returned Device: If a quote is refused or a repair is terminated for any reason, the device will be returned to you in its current state. You acknowledge that the device may be partially disassembled, and the physical condition or functionality may have changed as a result of the diagnostic process.
7. No Further Liability: Once the device is collected after a quote has been refused or a repair terminated, PC Fix is not liable for any issues that may arise with the device. The responsibility for the device and its condition is transferred back to you upon collection.
This section outlines our policy for items that are not collected.
1. Notification and Collection Period: We will notify you as soon as your device is ready for collection or a quote has been refused. All communication and attempts to contact you will be logged on your intake form. The one-month period before an item is considered abandoned will be calculated from the date of our initial notification. You will then have a period of 7 days to collect your device with no additional charge.
2. Storage Fees: After the initial 7-day period, a storage fee will be applied to your device. This fee will increase based on the duration of storage.
After 7 days, a storage fee of £20 will be added to your bill.
After 14 days, the storage fee will increase to £45.
After 21 days, the storage fee will increase to £65. Storage fees are payable in full upon collection of the device.
3. Abandonment of Goods: Any device that has not been collected and paid for within a period of one calendar month from the original notification date will be considered abandoned. Any subsequent contact or arrangement for collection does not extend this one-month period. You agree that after this period, we will have the right to sell or dispose of the device to recover any outstanding costs, including the original repair fee, diagnostic fee, and accrued storage fees.
4. No Further Liability: Once a device is considered abandoned, PC Fix is no longer liable for its condition, security, or contents. The responsibility for the device is forfeited upon the conclusion of the one-month period.
This section outlines the limits of our legal and financial responsibility.
Maximum Liability: You agree that the maximum liability of PC Fix for any damage or loss, regardless of the cause, is strictly limited to the total cost of the repair services provided. We will not be liable for any incidental, indirect, or consequential damages.
No Liability for Consequential Loss: We are not liable for any loss of income, loss of business opportunities, or lost profits that result from the failure of your device or any delay in our services.
Third-Party Components: We are not responsible for the performance or failure of any third-party software or hardware installed on your device. Any warranty on these items is provided by the original manufacturer, not PC Fix.
This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. You and PC Fix irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation.
